This brouhaha about Michael Phelps taking a bong hit really burns me.

This guy is the most decorated athlete in history. He spent the bulk of his life in rigorous training. He's been drug tested by every athletic agency in the world. And he's a twenty-four year old kid.

He deserves a break.

I challenge you to show me a party of twenty-something affluent athletes and actors and aspiring celebs where there AREN'T bongs present.

It's not like taking a bong hit is immoral or sinful or even harmful. Phelps wasn't an evangelical preacher caught in a motel room with a prostitute. He was a kid at a party where there was a bong circulating.

Phelps has made a prostrate apology saying that he'll never do it again. What he should never do again is let someone take his picture while he is bonging it.

i agree. it's that picture that was his mistake. he should sue the s.o.b. that took the pic for invasion of privacy. i heard this a.m. some comment that the city he was in may prosecute him for smoking dope in their town... hard to believe.

all I can say about a prosecution of Phelps by whoever that upstart prosecutor is, good luck. That photo was sensational but it is hardly evidence. They can't tell from that picture if he was smoking crack or pot or if he was just aping and posing.

It's just a case of a two-bit lawyer trying to hitch his wagon to a star.

There will be no problem, eLRod, if "the little upstart, two-bit lawyer trying to hitch his wagon to a star," hears about this reply. He'll certainly back down if he has a nickle worth of brains. If he doesn't let's you I confront the asshole and defend Phelps the Aquaman. It may be profitable.

I recently read somewhere that digital photos are no longer admissable as evidence. Too easy to photoshop them.

The principal requirements to admit a photograph (digital or film-based) into evidence are relevance and authentication. Unless the photograph is admitted by the stipulation of both parties, the party attempting to admit the photograph into evidence must be prepared to offer testimony that the photograph is an accurate representation of the scene. This usually means someone must testify that the photograph accurately portrays the scene as viewed by that witness.

I mean, if you can make a baby talk on a Blackberry about stock trading with the voice of a thirty year old, you can make Gandhi getting head from Mother Theresa.
