OK .... IF I were a software developer who had created software under the name Studio 8 prior to the time they had created software under the name Studio 8, I might have a case.
But I really doubt whether I'd have one since what I have is a website by that name and what they have is software by that name. We're not in competition with each other.
So, my joking around was to rub in the fact that they are using a GREAT name and I know it's a great name because I made it up and was using it myself several years before they started using it.
I'm pretty sure that any lawyer would tell me that if I looked in the phone book, I could find Acme Supermarket and Acme Toys and Acme Widgets and Acme Home Improvement and Acme Fitness Center and Acme Lightbulbs and since none are in competition with each other, they can use the same name without a problem.
I may be wrong.
If you know of an attorney, edog or firsty, who can tell me I'm not understanding this properly and that there really IS a trademark infringement even though we're in two different businesses, let me know, OK?
'Cause the name is a really good one and if they're making money on a name I created, maybe I deserve some of that money to help operate this site.
